Terms of Service
Effective October 13, 2026
The short version
- Your photos, words and memories stay yours. You let us store and show them only so Passage can work for you.
- Only add things you have the right to share, and be thoughtful about the people in your photos.
- Keep a copy of anything irreplaceable — we take care of your memories, but no service is perfect.
- You can stop using Passage and delete your account at any time.
1. About these terms
These terms are an agreement between you and W - M Consulting & Technology Inc. ("we", "us"), the company that owns and runs Passage — the travel journal and photo book service at mypassage.co and in our iPhone and Android apps (together, "Passage"). By creating an account or using Passage, you agree to these terms and to our Privacy Policy, which explains how we handle your information. If you don't agree, please don't use Passage.
2. Who can use Passage
- You must be 18 or older to create a Passage account and agree to these terms.
- Children and teens under 18 can take part only through a parent or guardian — for example a kid's journal the parent keeps or sets up for them. The parent or guardian agrees to these terms on the child's behalf, supervises their use, and is responsible for it.
- You're responsible for keeping your sign-in secure and for activity on your account. Tell us right away if you think someone else has accessed it.
3. Your content belongs to you
Everything you add to Passage — photos, videos, journal entries, captions, voice memos, places, books and the rest ("your content") — remains yours. We don't claim ownership of it.
So that Passage can work, you give us a limited permission to store, copy, resize, process and display your content, only to provide the service to you and to the people you choose to share with. That includes, for example, making thumbnails, sorting photos by date and location, building your Story and books, running AI features when you ask for them, and — when printed books are available and you order one — sending your book to our printing partner. This permission is worldwide and royalty-free, and it ends when you delete the content or your account (apart from copies in backups for a short time, or where the law requires us to keep something).
We won't sell your content, use it in advertising, or use it to train AI models.
4. Your responsibilities for what you add
Only add content you have the right to add. In particular, you agree that:
- you took the photos and wrote the words yourself, or have permission from whoever did;
- you're comfortable sharing images of the people in them — especially children — with the people you invite, and you'll respect anyone who asks you to remove a photo of them;
- your content isn't illegal, doesn't infringe anyone's rights, and doesn't include sexual content involving minors, content that harasses or threatens others, or someone else's private information shared without their consent.
We don't routinely review private content, but we may remove content or suspend an account if we're told about, or become aware of, content that breaks these terms or the law, and we'll report child sexual abuse material to the authorities.
5. Sharing and collaborating
- Trips are private to you unless you share them. When you invite co-writers, they can add to the trip; what they add stays theirs, and they give the trip owner and other members permission to see it as part of the trip.
- Viewers you invite, and anyone you send a share link to, can see what you've chosen to share. Links can be forwarded, so share them with people you trust. You can stop sharing at any time, though we can't take back copies someone has already saved.
- If you leave a trip or delete your account, trips you co-wrote but don't own stay with their owner.
6. Using Passage fairly
Please don't misuse Passage. For example, don't:
- try to access accounts, trips or data that aren't yours, or get around our security or sharing limits;
- disrupt or overload Passage, or use bots or scrapers on it;
- copy, resell or reverse-engineer Passage, except where the law allows it;
- use Passage to send spam or for anything unlawful.
7. AI and automatic features
Some features suggest things for you — tidying your writing, turning captions into an entry, suggesting places from your photos, choosing moments for your Story or book. These suggestions can be wrong or incomplete. Nothing is added to your journal unless you accept it, and you're responsible for what you choose to keep or share.
8. Photo books and purchases
Books can currently be created and downloaded as PDFs. When printed books and other paid products become available, prices, shipping, delivery times and refund terms will be shown before you pay and will form part of these terms for that order. Please check your book carefully before ordering — we print what you approve. Nothing in these terms limits any rights you have under consumer protection laws that apply to you.
9. Other services we connect to
Passage works with services run by others — for example Google (sign-in, maps, Google Photos), Apple and Google app stores, and the speech recognition on your device. Your use of those services is also covered by their own terms. We're not responsible for services we don't control.
10. Our service
- Passage, its design, software and name belong to us. Apart from your content, these terms don't give you any rights in Passage beyond using it as intended.
- We're always improving Passage, so features may change, and we may add, limit or remove features. If we ever decide to shut Passage down, we'll give you reasonable notice and a way to download your journal and photos first.
- If you send us ideas or feedback, we may use them freely without owing you anything.
11. Keep your own copies
We work hard to keep your memories safe, but no online service can promise it will never lose data or be unavailable. Please keep the original photos and anything else that matters to you somewhere else too, such as on your phone or computer.
12. Ending your use of Passage
You can stop using Passage at any time and delete your account in Settings, which deletes your content as described in our Privacy Policy. We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires it; where reasonable, we'll tell you first and give you a chance to download your content. Sections that by their nature should continue (such as 3, 13, 14 and 16) continue after your account ends.
13. Disclaimers
Passage is provided "as is" and "as available". To the extent the law allows, we don't make promises beyond those in these terms — including that Passage will always be available, error-free or suitable for a particular purpose. Some places don't allow these exclusions, so they may not all apply to you.
14. Limits on our liability
To the extent the law allows, we aren't liable for indirect, incidental, special or consequential losses, or for loss of data, profits or goodwill, arising from your use of Passage. Our total liability to you for any claim about Passage is limited to the greater of (a) the amount you paid us in the 12 months before the claim and (b) CAD $100. Nothing in these terms limits liability that can't legally be limited, such as for our fraud or gross negligence, or your rights as a consumer.
If you use Passage in a way that breaks these terms or the law and someone makes a claim against us because of it, you agree to cover our reasonable losses from that claim, to the extent the law allows.
15. Changes to these terms
We may update these terms as Passage changes. If a change is significant, we'll tell you by email or in the app at least 30 days before it takes effect (unless the change is needed sooner for legal or security reasons). If you keep using Passage after the change, the new terms apply; if you don't agree, you can delete your account.
16. Governing law and disputes
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. If there's a problem, please contact us first — most things can be sorted out quickly. Any dispute that can't be resolved informally will be handled by the courts of that province, unless the consumer protection laws where you live give you the right to bring a claim in your local courts, in which case you keep that right.
17. Using our iPhone app
If you use our iPhone app, these terms are between you and us, not Apple. Apple isn't responsible for the app or its content, has no obligation to provide maintenance or support for it, and isn't responsible for any claims relating to it (including product liability, legal compliance or intellectual property claims). If the app fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you're not located in a country subject to a government embargo or on any government list of prohibited parties. Your use of the app must also follow the App Store's terms.
18. General
If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term straight away, we haven't given up the right to. You can't transfer these terms to someone else; we may transfer them as part of a merger or sale of our business, and this would not reduce your rights. These terms and our Privacy Policy are the whole agreement between you and us about Passage.
